1. INTRODUCTION

1.1 This Website Privacy Policy (Policy) explains how Asha Property Advisory, trading as ashapropertyadvisory.com.au (Asha Property Advisory, we, our, us), collects, uses, discloses and protects personal information in connection with our website ashapropertyadvisory.com.au and any related online tools or forms (collectively, the Website).

1.2 We are committed to complying with the Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles (APPs) in Schedule 1, the Spam Act 2003 (Cth) (Spam Act), and any other applicable privacy or data protection obligations.

1.3 This Policy applies only to personal information collected through the Website. It does not apply to information collected offline, via third party platforms (except where those platforms collect information on our behalf), or in connection with our buyer’s agency services except to the extent that such information is collected via the Website.

2. DEFINITIONS

2.1 In this Policy, unless the context otherwise requires:

  • APPs means the Australian Privacy Principles in Schedule 1 to the Privacy Act.
  • Personal Information has the meaning given in the Privacy Act and includes information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in a material form or not.
  • Spam Act means the Spam Act 2003 (Cth).

3. PERSONAL INFORMATION WE COLLECT VIA THE WEBSITE

3.1 We may collect and handle the following categories of Personal Information via the Website:

(a) Identity and contact information – name, email address, telephone number, postal and residential address, and any other identifiers you provide when you contact us via online forms or email links on the Website.
(b) Property search information – property preferences, budget, desired locations, investment or owner occupier objectives, and other buying requirements you disclose to us via online forms on the Website.
(c) Technical information – IP address, device identifiers, browser type, operating system, access times, pages viewed, and usage statistics collected via cookies, log files and analytics tools.
(d) Marketing and newsletter information – email addresses and related details you provide when you subscribe to our newsletter, updates or other marketing communications via the Website.

3.2 We do not collect sensitive information (such as race, religion, health information or criminal records) via the Website unless you voluntarily provide it and it is reasonably necessary for our functions.

4. HOW WE COLLECT PERSONAL INFORMATION VIA THE WEBSITE

4.1 We collect Personal Information directly from you via the Website when you:

4.4 Collection of contact details via social media and online forms

4.4.1 We may collect your name, email address and other contact details when you interact with us via:

  • social media platforms (for example, by clicking through from our social media posts to our Website, or completing a lead form or sign up form that is linked from platforms such as Facebook, Instagram, LinkedIn or similar services); or
  • our website forms, landing pages or pop ups (for example, where you subscribe to our newsletter, request updates or download guides).

4.4.2 Where we collect email addresses or other contact details through social media or online forms for the purpose of sending newsletters or other marketing communications, we will:

  • obtain express consent (for example, by requiring you to tick an unchecked box or complete a sign up form that clearly states you are subscribing to receive our newsletter or marketing emails); and
  • keep records of when and how consent was obtained, in order to demonstrate compliance with the Spam Act and the Privacy Act.

4.4.3 We will not treat the mere publication of an email address on a social media profile or website as consent for marketing purposes. Consent must be express or reasonably inferred from your conduct and relationship with us, in accordance with the Spam Act.

5. PURPOSES FOR WHICH WE USE PERSONAL INFORMATION COLLECTED VIA THE WEBSITE

5.1 We use Personal Information collected via the Website for the following purposes:

(a) to respond to enquiries, requests and complaints made via the Website;
(b) to provide information you request via the Website (e.g. guides, resources, updates);
(c) to send marketing and promotional communications about our services, where you have consented or where permitted by law (see section 10);
(d) to improve, maintain and secure our Website, including through analytics, testing and monitoring; and
(e) to comply with our legal and regulatory obligations, including under the Privacy Act, Spam Act and other applicable laws, and to respond to lawful requests from regulators and law enforcement.

5.2 We will not use your Personal Information collected via the Website for secondary purposes unless you have consented, the secondary use is related (or in the case of sensitive information, directly related) to the primary purpose and you would reasonably expect such use, or another exception in the APPs applies.

6. DISCLOSURE OF PERSONAL INFORMATION COLLECTED VIA THE WEBSITE

6.1 We may disclose Personal Information collected via the Website to:

(a) our employees, contractors and agents, to the extent they need the information to perform their duties;
(b) service providers who support our Website operations, including IT, hosting, email, CRM, analytics and payment processing providers;
(c) professional advisers such as lawyers and accountants engaged by us;
(d) regulatory bodies, law enforcement agencies, courts and tribunals, where disclosure is required or authorised by law; and
(e) any other person or organisation where you have expressly authorised us to disclose the information.

6.2 We do not sell your Personal Information to third parties.

6.3 We may disclose Personal Information to overseas recipients where reasonably necessary for our functions (for example, where a cloud service provider hosts Website data in another country). We will take reasonable steps to ensure any overseas recipient complies with privacy protections equivalent to the APPs, consistent with APP 8, unless an exception applies.

7. DATA STORAGE, SECURITY AND RECORD RETENTION

7.1 We take reasonable steps to protect Personal Information collected via the Website from misuse, interference and loss, and from unauthorised access, modification or disclosure, as required by APP 11.

7.2 Measures may include:

(a) secure cloud and server environments with encryption at rest and in transit where appropriate;
(b) access controls, authentication and role based permissions;
(c) up to date software and security patches; and
(d) secure destruction or de identification of Personal Information when no longer required for lawful purposes and after expiry of mandatory retention periods.

7.3 No method of electronic storage or transmission is completely secure. While we take reasonable steps to protect Personal Information, we cannot guarantee absolute security.

8. COOKIES AND TRACKING TECHNOLOGIES

8.1 We use cookies, pixels and similar technologies on the Website to:

(a) improve user experience (e.g. remembering preferences);
(b) analyse website performance and usage; and
(c) understand how visitors interact with our content, for the purpose of improving our services.

8.2 You may configure your browser to reject cookies or to notify you when a cookie is set. However, disabling cookies may affect the functionality of the Website.

9. ACCESS TO AND CORRECTION OF PERSONAL INFORMATION

9.1 Subject to applicable exceptions under the APPs, you may request access to the Personal Information we hold about you and request correction if the information is inaccurate, out of date, incomplete, irrelevant or misleading.

9.2 Requests should be made in writing to our Privacy Officer (see section 13). We will respond within a reasonable time and in accordance with the Privacy Act.

9.3 Where we refuse access or correction, we will provide written reasons for the refusal and advise you of any avenues for complaint.

9.4 We may charge a reasonable fee for providing access to Personal Information, but not for making a request or for correcting information.

10. DIRECT MARKETING AND COMMUNICATIONS

10.1 We may use your Personal Information (including email addresses collected via our Website, social media platforms or online forms) to send you direct marketing communications about our services where:

  • you have given express consent to receive such communications (for example, by subscribing to our newsletter, ticking an opt in box or otherwise clearly requesting marketing emails); or
  • you would reasonably expect us to use your information for that purpose and it is otherwise permitted by law, consistent with APP 7 and the Spam Act.

10.2 In accordance with the Spam Act, we will ensure that every commercial electronic message (including marketing emails) we send:

  • is sent with valid consent;
  • clearly and accurately identifies Asha Property Advisory as the sender and includes our business name and contact details; and
  • contains a functional unsubscribe facility that is clearly presented, easy to use, remains functional for at least 30 days after the message is sent, and allows you to opt out of receiving further marketing messages from us.

10.3 You may opt out of direct marketing at any time by using the unsubscribe link in our emails or contacting us using the details in section 13.

10.4 Opting out of marketing will not affect service related communications that are necessary for us to provide our services or comply with our legal obligations.10.5 We will not send unsolicited marketing emails harvested from social media, public websites or other sources where consent has not been obtained, and we will not use misleading subject lines, false representations or deceptive practices in our digital advertising or social media campaigns, in compliance with the Australian Consumer Law and Victorian guidance on misleading or deceptive conduct.

11. ANTI MONEY LAUNDERING AND COUNTER TERRORISM FINANCING (AML/CTF)

11.1 In some circumstances, we are required by law to collect, verify and disclose Personal Information. For example, from 1 July 2026, changes to the AML/CTF regime mean that real estate and buyer’s agents must have an AML/CTF program and undertake customer due diligence (CDD) before providing designated services.

11.2 We may therefore be required to collect and disclose your Personal Information under the AML/CTF Act and any other applicable legislation or regulatory instrument that imposes obligations on us when brokering the purchase, sale or transfer of real estate.

11.3 If you do not provide information we reasonably request for these purposes, we may be unable to verify your identity, comply with our AML/CTF obligations, or provide or continue to provide our services or complete your request.

11.4 We retain AML/CTF records (including CDD records, transaction records and AML/CTF Program documents) for at least seven (7) years from the relevant date prescribed under the AML/CTF Act and AUSTRAC guidance. This retention is mandatory and may override APP 11.2 to the extent of any inconsistency.

12. CHANGES TO THIS POLICY

12.1 We may update this Policy from time to time. The updated Policy will be published on the Website with a revised “Last Updated” date.

12.2 Your continued use of the Website and our services after an update constitutes acceptance of the updated Policy.
